On February 24, 2025, our firm filed an Application for Authorization to Institute a Class Action Against Audi Canada Inc. This application seeks payment for the repair of damage to members’ vehicles caused by the excessive oil consumption problem, as well as damages and punitive damages.
Problem of excessive oil consumption
Under the Consumer Protection Act, a consumer who buys a product is entitled to have it used for the normal use for which it is intended and to have its good working life reasonable, taking into account the price paid and the use he makes of it.
However, in recent years, a problem of excessive oil consumption in certain Audi vehicles has been observed throughout North America.
Our client’s story
In 2019, our client, Mr. St-Amant, acquired a 2015 Audi Q3, which was in perfect condition at the time of its purchase and certainly did not show any signs of excessive oil consumption.
On or about November 3, 2022, our customer performed a routine oil change while his odometer showed 107,722 kilometres. However, shortly before the spring of 2023, the oil level indicator on his vehicle came on, forcing him to add about one (1) litre of oil to the engine to ensure proper operation. On or about April 14, 2023, our customer again performs a routine oil change with 114,737 kilometres on the odometer. However, once again, the indicator lights up about a month after this last change. Our customer then takes his vehicle to the garage, where a technician tells him that this is a common problem in Audi vehicles, especially in vehicles equipped with a two (2) liter turbocharged stratified injection (TFSI) engine. Our customer then consults with their dealer, who believes that it will be necessary to change the engine pistons, or even the entire engine to remedy the problem, which could cost our customer up to $20,000. However, the dealer did not agree to carry out a repair free of charge, on the grounds that the warranty had expired.
As the problem of excessive oil consumption persisted, our client had to carry out research and laborious procedures, at his own expense, in order to try to remedy the problem. However, our client would not have bought his car or given such a high price if he had been informed of the existence of this problem, which directly affects the quality of the vehicle, its life expectancy and its reliability, which are important elements that influence his decision to contract for the vehicle.
By searching on the Internet, our client notices, especially through forums and blog articles, that a large number of owners of Audi brand vehicles suffer from the same problem of excessive oil consumption.
