On May 21, 2024, our firm filed an application for authorization to institute a class action against Ticketmaster. This request seeks a reduction in the price paid for all consumers who purchased U.S. dollar tickets for events in the U.S. from Ticketmaster’s website or mobile app.
Our client’s story
In February 2024, our client purchased a ticket for a Brooklyn Nets basketball game in New York City from Ticketmaster’s Canadian website, www.ticketmaster.ca, while in Quebec.
Our client read the sale price of the ticket, before being redirected to a new web page where he proceeded with the transaction.
Since there was no currency next to the amount to be paid, our client believed that the amount was displayed in Canadian dollars.
A few days later, when our client looked at his bank statement, he realized that, in reality, the price was displayed in U.S. dollars. He then realized that he had paid considerably more for his ticket than he thought.
The proposed class action
In accordance with the Consumer Protection Act, a merchant who enters into a contract with a consumer at a distance, in particular through a website, is required to disclose the currency in which the amounts are payable, when that currency is other than Canadian. The same law also prevents the merchant from charging a higher price for a good or service than advertised. Under this law, a merchant cannot ignore an important fact when making representations to the consumer, particularly with regard to price.
However, Ticketmaster sells tickets to Canadian consumers in U.S. dollars, without ever indicating to them that the price of the tickets is displayed in U.S. dollars rather than Canadian dollars. Ticketmaster thus misleads consumers into paying more than they think for their tickets.
Thus, on behalf of our representative and all aggrieved members, we are seeking a reduction in the price of the tickets equivalent to the amount paid in excess of what they would have paid if the price of the tickets purchased had been displayed in Canadian dollars, as well as punitive damages to sanction Ticketmaster’s conduct.
The target group
All natural persons domiciled or having been domiciled in Quebec who have purchased one or more tickets on the Ticketmaster mobile application or on the Ticketmaster website and who have paid for their ticket(s) in U.S. dollars since May 21, 2021.
