On March 17, 2021, our firm filed an application for authorization to bring a class action against Samsung. This application seeks compensation for Quebec consumers who purchased one of the Samsung-branded refrigerator models covered by its service bulletins in 2015 and 2017.

Our customers’ story

Our customers purchased a Samsung-branded French door refrigerator with water and external ice dispenser in 2014.

After only 4 years of use, they began to have problems with this refrigerator, in that it no longer provided ice due to frost and blockage of the ice compartment and that there was an accumulation of water, especially under the snack drawer “Flex Zone”.

The plaintiffs had to manually remove the ice about once a month, in addition to buying ice packs at the grocery store or using ice cube molds to stock up on ice.

On a few occasions, the plaintiffs also had to turn off and unplug their refrigerator for several hours in order to thaw the ice compartment, as they were completely unable to remove it.

Our customers believe that these problems seriously compromise the functionality of their refrigerator, as it now requires constant and continuous maintenance on the part of the applicants, without which the ice machine becomes unusable.

Consumer Protection Act

Under the Consumer Protection Act, un consumer who purchases a product is entitled to have it used for the normal use for which it is intended and to have a reasonable period of proper operation, taking into account the price paid and the use he makes of it. In the case of a refrigerator, its reasonable shelf life is about 18 years.

In its 2015 and 2017 service bulletins, Samsung acknowledges some of the issues experienced by consumers, including ice chamber freezing and water buildup under drawers, as well as some design flaws in 56 models of its French door refrigerator models with external water and ice dispenser.
However, Samsung continues to market, distribute and sell certain models of these refrigerators to the public, without disclosing these problems. As a result, we allege that Samsung has ignored an important fact, namely the quality of its products, which is a determining factor that may influence the informed choice of the consumer.

All natural persons resident in Quebec who have purchased one of the following Samsung-branded French door refrigerator models with water and external ice dispenser covered by Samsung service bulletins ASC20150717001 and ASC20170602002:
