On September 29, 2023, our firm filed an application for authorization to institute a class action against Laurentian Bank. The purpose of this application is to obtain compensation for Laurentian Bank customers who were deprived of services due to the outage of September 24, 2023.
Our client’s story
On September 24, 2023, Laurentian Bank suffered a major outage causing an interruption in its services resulting from an update to their computer systems. Since then, thousands of Laurentian Bank customers have been unable to use their services contracted with the bank, including online services, transactions, ATMs and cheque cashing.
Our client is a Laurentian Bank client and has held a bank account there since 2005. She pays a flat fee of $4.00 per month to access her services.
Since September 24, 2023, our client is unable to use her services, in particular in that she does not have access to her income.
Our client tried to reach Laurentian Bank and waited unsuccessfully for more than an hour and only obtained information via Facebook.
The fault
The provision of the services provided for in the contract and therefore accessibility to the bank’s services is Laurentian Bank’s main obligation and a fundamental element at the heart of the contract between the members of the Group and Laurentian Bank.
We claim that it not only failed to take sufficient measures to prevent the outage, to provide the contracted service and to adequately communicate information relating to the monitoring of the outage, and this, by communicating to its users a misleading scenario.
Target group
All natural or legal persons who had a service contract with the defendant and who were unable to use the services contracted since September 24, 2023 due to a service interruption until the restoration of said services.
Applications lodged with the Court
Application for authorization to bring a class action
Current status of the file
Awaiting authorization by the Superior Court.
How can I be part of the class action?
If you fall within the definition of the group referred to above, you are automatically part of this class action.
We strongly recommend that you keep all relevant evidence (proof of payment of monthly fees and costs incurred by the outage, important communications with Laurentian Bank related to the outage, etc.).
