The Review Officer shall have ninety (90) days to render a review decision from the time when:
- receives your request for administrative review;
- receives the latest document in support of your representations for review;
- or any additional time you have requested.
The review decision will have as a possible conclusion:
- accept your request (agree with you);
- partially accept your application (for example, the SAAQ may refuse the causal link on a diagnosis, but agree to increase the severity class it has already recognized);
- refuse your request.
Do not think that the officer will prove you right in terms of administrative review without making fair representations. You need a thorough knowledge of the law and case law in order to be able to properly demonstrate your claims.
In our experience, the majority of initial decisions are maintained at the review stage. We estimate that about 90% of our cases are progressing to the next stage, which is the challenge of the review decision before the Administrative Tribunal of Quebec.
