On February 24, 2025, our firm filed an Application for Authorization to Institute a Class Action Against Uber Canada Inc. and Uber Portier Canada Inc. This request seeks a refund of the taxes overpaid by users of the Uber Eats platform and punitive damages for the benefit of the members of the targeted group.
Illegal fees
OnFebruary 1 , 2024, our customer places an order on the Uber Eats mobile app. During this transaction, our customer applies a promotional code granting a 50% discount on the order, up to a maximum of $20.00.
However, when checking his invoice after payment, our customer suspects that he has been overcharged. In fact, after analysis, our client found that he had paid an amount of taxes based on the price of his cart before the application of his discount, whereas he expected to pay an amount of taxes based on the price of his cart after the application of his discount.
Our client then continued his investigations and noticed that this was a widespread practice on the Uber Eats platform. However, our client believes that the amount of taxes must be calculated on the net value of each order, after application of any promotional code, in accordance with tax standards. Our client is therefore seeking by this class action to obtain a refund of these overpaid taxes.
Target group
All natural persons who have made a transaction in Québec on the Uber Eats mobile application or on the www.ubereats.com website since February 24, 2022 and who have applied a promotional code to this transaction.
