On February 14, 2025, our firm filed an application for authorization to institute a class action against Kia Canada Inc. This application seeks payment for the repair of damage to members’ vehicles caused by paint delamination, as well as damages and punitive damages.
Paint problem
Under the Consumer Protection Act, a consumer who buys a product is entitled to have it used for the normal use for which it is intended and to have its good working life reasonable, taking into account the price paid and the use he makes of it.
In Quebec, owners of new vehicles keep their cars for an average of more than eight (8) years, with about one-third of them between eleven (11) and fifteen (15) years.
Kia Canada warrants paint defects in the cars it manufactures for a period of thirty-six (36) months or 60,000 km, whichever comes first.
However, in recent years, a phenomenon of plate detachment in Kia vehicles, more particularly in “white” or “pearl white” colours, has been observed.
Our client’s story
In March 2021, our client acquired a 2015 Kia Sorento A LX AWD, in white. At the time of purchase, the vehicle had accumulated 53,104 kilometres on its odometer.
However, in 2022, the applicant noticed for the first time a few spots of paint peeling off the hood and on the side of the windshield of his vehicle.
In 2024, our customer noticed that the problem was getting worse and reported the problem to Kia, which refused to repair his vehicle on the grounds that our customer would no longer be covered by the contractual paint warranty.
Our client believes that it is unreasonable for the surface of his vehicle to show such great degradation after seven (7) years and 90,000 to 100,000 kilometres of use, when he has always maintained his vehicle well and driven safely since its purchase.
The target group
All persons who have purchased or leased a white Kia motor vehicle on a long-term basis, including vehicles that are “snow white pearl”, “snow white”, “ice white pearl” and “celestial white”.
