On February 20, 2026, our firm filed an Application for Authorization to Institute a Class Action against Abbatiello Group Inc. and Abbatiello Group Franchises Inc., regarding a massive leak of personal information targeting former and current employees of the defendants. This request seeks compensation for all individuals whose personal information has been compromised.
Our client’s story
Our client is a former employee of Pizza Salvatoré, having worked there as a delivery man in 2021 and 2023. On February 18, 2026, our client received a letter from the defendants informing them that they had been the victims of a cyberattack on the morning of February 17, 2026. Our client then learned that several of his personal information held by the defendants, including his name, address, date of birth, social insurance number, etc., would therefore be compromised.
Our client promptly contacted the defendants to see if any steps would be taken to protect his personal data and monitor his credit report to limit potential fraud, but learned that no action or compensation was being considered by the defendants.
Since February 18, 2026, our client has been very concerned about the risks of fraud that could result from the leak of personal information. In order to limit the risk of fraud, our client inspects his bank account every day and is obliged to subscribe to a credit monitoring service at his own expense.
The proposed class action
In accordance with the Civil Code of Québec and the Act Respecting the Protection of Personal Information in the Private Sector (PIPPA), the defendants have an obligation to ensure the security of the personal information they hold. Considering the defendants’ failure to ensure the confidentiality of its information, our client is entitled to obtain compensatory and punitive damages from the defendants.
The proposed class
This class action concerns all individuals whose personal and/or financial information was compromised during the cyberattack on the Abbatiello Group’s servers on February 17, 2026.
