If you disagree with the review decision of the Société de l’assurance automobile du Québec (SAAQ), you can challenge it at the Administrative Tribunal of Québec (TAQ) by filing a motion to initiate proceedings. The time limit for challenging the said decision is normally sixty (60) days.
As of the contest of the decision before the Tribunal, the SAAQ has thirty (30) days to send you a copy of the administrative file justifying their review decision.
It is important not to lose, misplace or mix the documents received by the SAAQ, since otherwise, you will be charged by the organization to obtain new copies. This is one more reason to contact a lawyer upon receipt of the initial notice of decision. In our experience, the sooner a lawyer embarks on a case, the better prepared the case and the greater your chances of success.
The Administrative Tribunal of Québec is an independent body that hears, among other things, disputes concerning:
- Société de l’assurance automobile du Québec (SAAQ)

- Retraite Québec (formerly RRQ)
- Welfare
The judges who will decide your dispute will normally be composed of a doctor, accompanied by a lawyer.

However, do not believe that you can simply go to conciliation and hope that you will get what you want. Having such a vision amounts to negligence. Be aware that a file is prepared as soon as the initial notice of decision is made and that you must have good arguments supported by concrete evidence to support your point of view.
