On November 14, 2022, our firm filed an application for authorization to institute a class action against Fever Labs Inc. The purpose of this application is to obtain reimbursement of management fees paid by Quebec consumers who purchased a ticket for an event on the Fever Labs Inc. website. or on its mobile application since May 28, 2019.
Illegal fees
Fever Labs Inc. operates an online platform for selling tickets for events, shows and experiences in more than 30 cities around the world.
In October 2022, our client purchased 2 tickets for the Harry Potter: The Big Christmas Ball event.
Tickets for this event were advertised for $85 for an adult and $65 for a child.
However, it was not until he went to the checkout that a management fee of approximately 15% of the ticket price was added to the prices initially advertised.
The Consumer Protection Act imposes obligations on merchants to ensure that consumers have all the information they need about the services rendered by a merchant from the first reading of all representations. More specifically with respect to price displays, the Act requires that the Total advertised price must include all amounts owing, excluding taxes.
