On November 29, 2021, our firm filed an application for authorization to institute a class action against Croisières AML. The purpose of this application is to obtain reimbursement of the booking and service fees paid by Quebec consumers who purchased tickets for an AML Cruises cruise.
Illegal fees
Croisières AML offers different cruises, such as guided cruises, dinner cruises, brunch cruises and day cruises in several cities in Quebec.
Consumers can purchase tickets in person, online or by phone.
Our client wanted to buy 2 tickets for a dinner cruise for a romantic dinner with his spouse. He was attracted by a package displayed in the amount of $114.99 per person.
However, at the end of the transaction, various additional fees were added to the amount of the tickets, namely:
- A reservation fee of $2 per person, plus taxes;
- A gratuity and meal service fee of $10.06 per person, plus taxes;
The Consumer Protection Act imposes strict obligations on merchants to allow Quebec consumers to have complete information before obtaining a good or service.
Under section 224 (c) of the Act, traders may not charge, by any means, a price higher than that advertised. Consequently, the advertised price must include all amounts owing, except applicable taxes, and clearly highlight the amounts of which it is composed, including delivery costs in this case.
Target group
All consumers who, since June 12, 2018, have paid a higher price than advertised for a cruise offered by Croisières AML.
