On September 3, 2026, our firm filed a class action against Voyages Bergeron, Voyages à Rabais, Vacances Sunwing, Vacances Air Transat, WestJet Vacations, and Air Canada Vacations. This claim seeks compensatory and punitive damages for individuals who made a reservation on one of the defendants’ website, on or about September 1, 2026, and who suffered a price increase or had their reservation(s) cancelled due to a pricing error.
Our client’s
story On September 1, 2026, our client became aware of an offer on the Voyages Bergeron website for an all-inclusive package in Mexico, whose flights are operated by Air Transat, at a cost of approximately $700.00, while some competitors were asking for more than $3,000.00 for a comparable package.
Proud of his discovery and convinced of the legitimacy of the offer, the applicant decided to buy the package for himself and his spouse. He made the payment and obtained confirmation of his reservation. However, that same evening, Voyages Bergeron told him that his reservation had been cancelled.
Disappointed, he did some research and noticed that several other Quebecers were in the same situation as him. He then decided to contact our firm to file the cash action.
The proposed
class action In accordance with the Consumer Protection Act, a business may not refuse to honour a contract it has entered into with the consumer, may not make misleading advertising statements as to price or service, and may not demand a price higher than that advertised.
Thus, from the time the contract is formed, merchants are bound by the terms of the contract and the representations they have made about the package and can neither refuse to honour the contract nor choose to claim a higher price than that advertised.
