On June 10, 2026, our office filed a class action lawsuit against Spartan Race Inc. and Spartan Race Canada Inc. This request seeks a reduction in obligations as well as punitive damages for all consumers who were forced to pay additional fees when transacting on the Spartan Race website or mobile app.
Our client’s story
On November 22, 2025, our client purchased the ” 2026 Canada Spartan Trifecta Pass” package on the Defendants’ website giving him access to three Spartan Races of his choice in 2026.
The package is initially listed at a price of $229.00, but ends up costing $284.07 to our customer due to an additional fee of $27.59 and taxes of $27.48. These fees are only announced to our customer at the very end of the purchase of their plan.
On April 6, 2026, our client uses his package to register for three (3) races in the Montreal area on the Defendants’ website. Since they have already purchased the initial package, our customer expects to pay no additional fees. However, when he tries to complete his registration, the Defendants still charge him an additional fee of $66.45, or $60 as a “Mandatory Service Bundle and $6.45 as Processing Fees .
This fee was not announced on November 22 when the package was purchased and it first appeared on April 6, 2026 at the very end of the registration process. In addition, our client noticed that these fees are mandatory and cannot be withdrawn.
Upon further research, our client notices that the Defendants have been adding this kind of additional fee illegally for a long time, as they even appear in two of its 2022 transactions.
The proposed class action
In accordance with the Consumer Protection Act, a business cannot impose an undisclosed excess financial obligation, make false or misleading representations or conceal the existence of additional fees.
